Terms of Service

Summary:

We’ll always do our best to fulfill your needs and meet your expectations. In this contract you won’t find any complicated legal terms or long passages of unreadable text. We’ve no desire to trick you into signing something that you might later regret. What we do want is what’s best for both parties, now and in the future.

What do both parties agree to?

You: You have the authority to enter into this contract on behalf of yourself, your company or your organization. You’ll provide the assets and information we tell you we need to complete the project.

You also agree to abide to the payment schedule as follows:

1st payment: 1/3 of the quote upfront as a non-refundable deposit. This is to cover expenses and getting the project “off the ground”, so to speak. The project begins as soon as the payment has been received.

2nd payment: 1/3 of the quote is due when you, the client, has been given access to view the site (using a password). At this point, 2 rounds of revisions can be made.

3rd payment: The remaining 1/3 is due after the website goes live (the password is removed and the website is public– it can be viewed by anyone).

Us: We have the experience and ability to do everything we’ve agreed with you and we’ll do it all in a professional and timely manner. We create all our websites using WordPress. We use Plugins for functionality (rather than custom development) to keep the costs down. We’ll try our best to meet every deadline that’s set and on top of that we’ll maintain the confidentiality of everything you give us.

General Process

Step 1: Identify Goals
We find out everything we need to know about your business, what you want to promote, and how we should structure your website. Example websites that you like are helpful to us at this stage.

Step 2: Collect and Organize Information
Send us all of your pictures, files and copy (text) that you would like on your website. We can do basic Photoshop work. Any drastic Photoshopping can be quoted separately. If you would like us to create content for you (take photos, write copy, etc.), this can be quoted separately.

Step 3: Website Design
After we have all your information collected, we start designing your website.

Step 4: Website Review / Final Adjustments
After the website is ready, we provide you with a password to view the website and check for anything that needs to be adjusted. You may request 2 rounds of adjustments/revisions. 1 round is 1 email with as many adjustments included as you like. If an adjustment/revision is too big (i.e. changing something drastic on the website), we can provide an additional quote. The choice of whether an adjustment is too big or drastic to include in the rounds is made at our (Clear Mountain Websites) discretion.

Step 5: Website Launch
We launch your website. Any further website changes or additions can be quoted separately. We can also set up any email accounts you wish to have (using webmail). If you would like to use Google mail (G Suite), we can provide an additional quote. At the time of this writing, G Suite costs $5/mo per user.

• Our design and development process generally takes less than 30 days but will depend on how long it takes for you to provide the information we need to build your website. It will also depend on the size of your website.

• Our designers will build a site that follows internet conventions, works on different devices, and looks good across various displays.

Refunds, Invoices, Payments, and Billing Email

Your deposit is non-refundable and no refunds are provided for the pre-payment of the ongoing service. Payments are required within 30 days of the invoice date. We reserve the right to suspend your website and email service if a payment is long overdue (after the three overdue reminders). We will give you a heads up and contact you before this happens so you’re aware. Your invoices will be sent by email to the billing email address we have on file and reminder emails will be sent if a payment is overdue. It is your responsibility to let us know if your billing email address has changed.

Ownership of Data, Files, Domains, and Email

You are solely responsible for all content you submit, provide or upload and the consequences for submitting, providing or uploading it. You remain the owner of your website and domain name, and all information and files you provide to us for creating your website. We will be listed as the registrant if you register your domain with us, but you own your domain name. We will gladly help you transfer it to another registrar free of charge. However, you will incur any transfer fee costs from your new registrar. If payment is not made to us to renew your domain, we will not renew it.

Cancellation or Termination of Hosting Service

You can cancel your hosting account at any time before your next billing date. Unfortunately, we cannot reimburse or refund you once you pay your annual hosting fee. Clear Mountain Websites is under no obligation to store your website or files and may delete your account and files. Please let us know immediately if you would like to transfer your website and files away and we can provide a cPanel compressed archive (zip file).

Browser Testing

Browser testing no longer means attempting to make a website look the same in browsers of different capabilities or on devices with different size screens. It does mean ensuring that a person’s experience of a design should be appropriate to the capabilities of a browser or device.

We test our work in current versions of major desktop browsers including those made by Apple (Safari), Google (Chrome), and Mozilla Firefox. We will also test to ensure that people who use current versions of Microsoft Internet Explorer for Windows get an appropriate experience. We won’t test in other older browsers. If you need an enhanced design for an older browser, we can provide a separate estimate for that.

Mobile Browser Testing

Testing on popular smaller screen devices is essential in ensuring that a person’s experience of a design is appropriate to the capabilities of the device they’re using. We test our sites using emulators from Google Chrome. Tests will be conducted using iPad, iPhone and Android emulators. We will not test in Blackberry, Opera Mini/Mobile, specific Android devices, Windows or other mobile browsers. If you need us to test using these, we can provide a separate estimate for that.

Cancellation of Service

We would hate to see you go, but if you need to cancel your service for any reason, just let us know. There is never a cancellation penalty and you keep control of your domain name, email addresses, and all of your website information. Unfortunately, we cannot offer refunds for any deposits, web hosting, or any payments already processed.

Our Terms of Service may be revised at any time, without notification to you, and you should review this agreement from time to time. Your continued use of our services shall be regarded as acceptance of any such revisions.
